Manufacturer liable for erroneous drug addiction claims

Abstract:

A case of manufacturer liability in the death of a patient as a direct result of Talwin (pentazocine) dependence is presented. The final court decision said that the manufacturer was liable for misrepresentation when advertising that the drug would not cause physical dependence since long term prescribing of pentazocine was based on this assumption.
