Three companies that lost their bid to overturn a Vermont law banning certain prescribing information from being mined and sold to drugmakers for marketing are asking for an injunction that would delay the law while they appeal the decision.

In April, a U.S. District Court judge deferred to the authority of the Vermont Legislature to stop the data vendors from mining and selling information that identifies the prescribers, allowing pharmaceutical companies to target their marketing efforts. The losing plaintiffs-IMS Health, SDI Health and Wolters Kluwer Health-on June 23 asked a three-judge panel of the 2nd U.S. Circuit Court of Appeals in New York to stop the law from going into effect July 1.
Previously, the 1st U.S. Circuit Court of Appeals upheld a similar law in New Hampshire and is set to hear a case involving data-mining prohibitions in Maine. The companies have asked the U.S. Supreme Court to review the New Hampshire decision.
