Abstract:

An overview of the dichotomy of liability between manufacturers of over-the-counter (OTC) and prescription drugs is presented, including reasons for the dichotomy of liability between prescription and nonprescription drugs, historical background of the dichotomy, effects of the dichotomy on liability, and the code of federal regulations regarding labelling for OTC drugs; court cases reflecting these issues are described.
