Abstract:
The European Commission’s proposal for a directive on pharmaceutical advertising is discussed. Advertisements to the general public for drugs without a marketing authorization and for prescription-only drugs are prohibited, as well as the distribution of free samples to the general public for promotional purposes. The directive prohibits any gifts, pecuniary advantages, or benefits in kind, directly or indirectly, to prescribers and suppliers in the course of promoting medicinal products. Self regulation (as in the Netherlands) is permitted, but only next to court or administrative procedures.
