Abstract:

The legality of payments made by drug manufacturers to health care providers for prescribing their products is discussed, including specifications of the antikickback statute, regulations issued by the Office of Inspector General (OIG) stipulating the discounts that would not be subject to prosecution, an exception in the antikickback statute for certain types of discounts, and recommendations to help manufacturers avoid violating the statute.
